Electronic Communications may be delivered to you by email. You agree that we may contact you by e-mail, using any email address that you provide to us.

Your consent covers all Communications relating to any Product offered by or through us. Your consent remains in effect until you give us notice that you are withdrawing it.

From time to time, you may seek to obtain a new Product. When you do, we may remind you that you have already given us your consent to use Electronic Records and signatures. If you decide not to use Electronic Records and signatures in connection with the new product or service, your decision does not mean you have withdrawn this consent for any other Product.

You have the right to withdraw your consent at any time. Please be aware, however, that withdrawal of consent may result in the termination of your access to our Electronic Services, including online account access, and your ability to use certain Products.

To withdraw your consent, you must contact us at (866) 448-7628 or email us at info@iadvancenow.com. Your withdrawal of consent will become effective after we have had a reasonable opportunity to act upon it.

It is your responsibility to keep your primary email address current so that we can communicate with you electronically. You must promptly call us at (866) 448-7628 or email us at info@iadvancenow.com to notify us of any change in your email or other electronic address. You understand and agree that if we send you a Communication but you do not receive it because your primary email address on file is incorrect, out of date, blocked by your service provider or you are otherwise unable to receive electronic Communications, we will be deemed to have provided the Communication to you. If you use a spam filter or similar software that blocks or re-routes emails from senders not listed in your email address book, we recommend that you add us to your email address book so that you can receive Communications by e-mail.

You acknowledge and agree that you affirmatively consent to do business electronically and that you and we both intend that the Electronic Signatures in Global and National Commerce Act (ESIGN Act) will apply to the fullest extent possible to validate our ability to conduct business with you by electronic means.

By providing your consent, you are also confirming that you are authorized to, and do, consent on behalf of the applicant.

Examples of electronic records covered by your consent include but are not limited to:

• This ESIGN Disclosure and Consent and any amendments;
• Other service or user agreements for online access to our Electronic Services, and all amendments to any of these agreements;
• All of the Communications related to any Product, except for those excluded by the terms of this ESIGN Disclosure and Consent;
• Any and all periodic account and activity statements, disclosures and notices we provide to you concerning your Products;
• Any notice or disclosure regarding fees or assessments of any kind, including late fees, overdraft fees, over limit fees, and returned item fees;
• Notices of amendments to any of your agreements and accounts with us; and
• Other disclosures and notices that we are legally required to provide to you or choose to provide to you in our discretion.

By submitting this form and checking the consent box below, you expressly consent to receive calls, prerecorded voice messages, and text messages (SMS/MMS) from iAdvance Now (“iAN”) at the mobile phone number you have provided, including messages sent using an automatic telephone dialing system (autodialer). These communications may include:

• Customer service communications and responses to your inquiries;
• Account notifications, status updates, and alerts related to your application or funding;
• Promotional and marketing messages regarding iAN’s products and services; and
• Other business-related communications from iAN and its affiliates.

IMPORTANT: Consent to receive calls or text messages is NOT a condition of purchasing any product or service from iAdvance Now. You may do business with us without providing this consent.

• Message frequency varies depending on your account activity and the nature of our communications with you.

Opting out of SMS messages will not affect your ability to receive calls or email communications from iAN, and will not impact your access to our Products or Electronic Services unless separately specified.

Mobile Opt-In Privacy: No mobile phone numbers or SMS opt-in information collected through this form will be shared with third parties or affiliates for their own marketing or promotional purposes. All mobile opt-in data is used solely by iAdvance Now for the communication purposes described herein.

By providing your mobile phone number and checking the consent box, you represent that you are the account holder or regular user of the mobile phone number provided, and that you are authorized to grant this consent.

The Merchant and Owner(s)/Officer(s) identified below (individually, an “Applicant”) each represents, acknowledges, and agrees that:

• All information and documents provided to iAdvance Now (“iAN”) are true, accurate, and complete;
• Applicant will immediately notify iAN of any change in such financial condition;
• iAN and its affiliates, representatives, successors, assigns, designers, agents, and partners (“Recipients”) are authorized to request and receive any investigative reports, credit reports, statements from creditors or financial institutions, verification of information, or any other information that iAN and its affiliates deem necessary;
• Applicant waives and releases any claims against iAN and any information-providers arising from any act or omission relating to the requesting, receiving, or release of information;
• Each Owner/Officer represents that he or she is authorized to sign this form on behalf of Merchant; and
• The Merchant and each Owner/Officer agrees to receive calls, texts, emails, or mail from iAN and its affiliates, subject to the SMS consent terms in Section 6 above.

You also authorize iAN to transmit this Application, along with any of the foregoing information obtained in connection with this Application, to any or all of the Recipients for the foregoing purposes.
